The Goa Government authorized district magistrates to exercise powers under NSA for three months citing the prevailing circumstances in the state.

About NSA:

Purpose and Objective:

oEnacted to prevent individuals from acting in a manner prejudicial to India’s security, public order, or essential supplies.

oDesigned as a preventive detention law, allowing authorities to detain a person before the commission of an offence if deemed a threat.

Authority and Administration:

oState Governments and Central Government can order preventive detention.

oDetention orders are usually issued by District Magistrates, Divisional Commissioners, or the Home Secretary.

Period of Detention:

oInitial detention: Up to 12 months (varies by state and circumstances).

oAdvisory Board Review: A board of High Court judges reviews the detention within 3 months.

oCan be extended with government approval.

Grounds for Detention:

oActions prejudicial to the security of India.

oActs disrupting public order.

oObstruction to essential supplies (food, water, medicine, fuel).

Safeguards and Rights:

oAdvisory Board review of detention.

oDetained person can make representation to the government.

oPeriodic reporting to ensure compliance with legal and human rights standards.

Constitutional Provisions:

oBased on Article 22(3) & (4) of the Constitution, which allows preventive detention for up to 3 months without parliamentary approval and longer with legislative sanction.
